On November 30, 2017, the Administrative Court upheld the Administrative Tribunal's judgment of 27 April 2017, according to which a private laboratory must be authorized to expand its activities in the field of pathological anatomy, since there is a national need justifying the exclusion of the monopoly of the National Laboratory of Health in this area.
The judges thus considered that "no impossibility currently exists in Luxembourg law to prevent a private operator, which otherwise fulfils the conditions provided by the applicable legislation, from obtaining the authorization required for the opening and exploitation of a laboratory of analyses of medical biology in the discipline of the pathological anatomy".
